Kentucky Cops Abused This Family All Because Their Home Smelled Like This Harmless Medication

Easily the most concerning aspect of our nation’s law enforcement today has to do with how cops gone wild are seldom held accountable when they do something wrong.

Once in a blue moon, cops will be found guilty of crimes they’ve committed, but far too often, corrupt bureaucracies make it so many rogue police officers get away with blatant crimes.

While the verdict is still out on the following story, the truth is, police abused a family all because their home smelled like this harmless medication.

A thorough glance at the evidence shows that one of the biggest failures in U.S. domestic policy is the “war on drugs.”

Drugs have been illegal for decades, and yet, they’re as readily available in small towns as they are in big cities.

And while the trend for passing laws legalizing marijuana is sweeping the nation, there are many states and localities still very much opposed.

That’s how it is in Kentucky. Even though marijuana is legal for medical use in several states surrounding the Bluegrass State, Kentucky doesn’t permit its residents to enjoy the health-improving benefits of marijuana.

Sadly, this recently left a family shaking in terror when SWAT teams busted through their door after receiving information from a tipster who said the occupants had bags of weed in the home.

After the police received the tip, an officer went to the house and claimed that “the smell of fresh marijuana could be smelled” on the front porch.

According to the officer, “the witness of the short stay [of an individual matching the description of the supposed drug user],” and “the strong fresh smell of marijuana on separate occasions,” combined with his “training and experience” provided probable cause for a search.

That search resulted in a SWAT team assaulting an unassuming family with flashbangs and violent entry into the home.

Jacob Sullum writing for Reason reports:

Ashlea Burr and Mario Daugherty say more than a dozen SWAT officers stormed into their home without warning on the morning of October 26, 2018, breaking the front door, setting off “exploding devices” (presumably flashbang grenades), and shouting commands while threatening them and their three teenaged children with “assault rifles.””

Now one would think that based on everything presented above, this is a clear case of the cops just doing their jobs.

But that’s where the reader (and the police) are wrong.

The tipster who supplied the information told police the names of the people dealing the dope were Anthony McClain and his girlfriend, Holly.

But the home the cops visited on multiple occasions was the rented residence of Burr and Daugherty.

And the forced entry into the home revealed there wasn’t any marijuana in the house.

The family was obviously terrified by the incident and has since filed a lawsuit against the police department.

While this is one of the few instances where the police didn’t commit a crime (so there’s nothing for them to get away with), it displays a massive problem with modern law enforcement.

As Burr and Daughtery said in their suit:

“It is completely unreasonable to execute a warrant that vaguely mentions someone potentially smoking marijuana at a residence with a SWAT team of 14 officers, exploding devices, forced entry, and assault rifles, particularly when no investigation was done to determine who lived in the Residence and given the other false statements and omissions in the affidavit.”

Hopefully, this family is compensated for having to suffer through such a nasty ordeal.
